General Conditions of Sale
1) Name of the Website and ownership of the domain name
1.1 These General Terms and Conditions of Sale (“General Terms and Conditions of Sale” or, alternatively, “GTCS”) govern the offer and sale of eBooks through the website www.leveltechnique.com (“Website”) by Marco Zanuso, residing at Via Vincenzo Periz, 33, 36100 Vicenza (VI). The Website is owned by Marco Zanuso, who is also the holder of the related domain name.
2) Scope of application
2.1 The offer and sale of the eBook through the Website constitute a distance contract governed by Chapter I, Title III (arts. 45 et seq.) of Legislative Decree of 6 September 2005, no. 206 (“Consumer Code”) and by Legislative Decree of 9 April 2003, no. 70, containing provisions on electronic commerce.
2.2 These General Terms and Conditions of Sale apply to all sales carried out by Marco Zanuso through the Website.
2.3 The General Terms and Conditions of Sale may be amended at any time. Any amendments and/or new conditions shall be effective from the time of their publication on the Website in the “Terms and Conditions” section. Users are therefore invited to access the Website regularly and to consult, before making any purchase, the most up‑to‑date version of the General Terms and Conditions of Sale. The General Terms and Conditions of Sale applicable are those in force on the date the purchase order is sent and are available in the Italian language.
2.4 Before submitting the order and thus before concluding the purchase contract for an eBook, the user is required to carefully read all the information that Marco Zanuso provides through the Website, both before and during the purchase procedure, and to examine these General Terms and Conditions of Sale, which Marco Zanuso makes available in the “Terms and Conditions” section of the Website and which may be stored and reproduced by the user.
3) Purchases on the Website
3.1 The purchase of the eBook through the Website is permitted to users acting as consumers, as defined in art. 3, para. 1, lett. a) of the Consumer Code, meaning natural persons who, in relation to the purchase of the Products, act for purposes unrelated to any commercial, craft, business or professional activity carried out, after registering on the Website in the manner indicated in art. 4 below. Natural persons are allowed to purchase only on condition that they are at least eighteen years of age.
3.2 Marco Zanuso reserves the right to refuse or cancel orders that: (i) come from a user with whom there is an ongoing legal dispute; (ii) come from a user who has previously violated these GTCS and/or the conditions and/or terms of any purchase contract with Marco Zanuso; (iii) come from a user who has been involved in any type of fraud and, in particular, in fraud relating to credit card payments; (iv) come from users who have provided false, invented, fictitious, incomplete or otherwise inaccurate identifying data and/or in any way not corresponding to the truth, or referring to third parties, or who have failed to promptly send to Marco Zanuso any documents requested by the latter or have sent invalid documents; (v) come from a user who has violated the prohibition set out in art. 4.3 below.
3.3 For each purchase made through the Website, the relevant commercial invoice will be issued. The user is therefore required to fill in the appropriate form made available through the Website. The commercial invoice will be sent to the user by email. For the issuance of the invoice, the information provided by the user through the appropriate form, entered on the Website at the time of registration and/or subsequently, shall be deemed conclusive, and the user guarantees that such information is truthful. The user undertakes to hold harmless and indemnify Marco Zanuso from any damage, compensation obligation and/or sanction that may arise for and/or be imposed on the latter in the event that such information is not accurate and/or does not correspond to the truth. No changes to the invoice will be possible after it has been issued.
4) Registration on the Website
4.1 Registration on the Website is free of charge. To register on the Website and create the related account, the user must fill in the appropriate form, entering the personal data requested therein, as well as an email address and a password, and click on the button at the bottom of the form. Registration will be confirmed to the user by email and, to complete the registration procedure, the user must click on the specific link contained in the communication received. The user is strictly forbidden, for the purposes of registration on the Website, to enter personal data of third parties, or data that are false, invented, fictitious and/or in any way not corresponding to the truth.
4.2 Registration on the Website allows the user, via a dedicated account (“Account”), to carry out, among others, the following activities: – manage his/her personal data and modify and/or update them at any time; – manage his/her privacy settings, withdrawing consent to the processing of personal data previously given or granting consents not yet given and choosing the visibility settings to be associated with each social activity and/or content and/or information and/or personal data uploaded and/or provided in connection with such activities; – if he/she has purchased an eBook, view the list of purchased eBook Licences and use such eBooks through the pages and links specifically dedicated.
4.3 Each user may have only one registration on the Website. It is therefore strictly forbidden for the user to create more than one account on the Website referring to the same natural person, even by using data that correspond to the truth. In the event of a violation of this prohibition, without prejudice to the provisions of art. 3.2 above, Marco Zanuso reserves the right to close all accounts referring to the same natural person. The user also undertakes to hold harmless and indemnify Marco Zanuso from any damage, compensation obligation and/or sanction arising from and/or in any way connected with the user’s violation of the prohibition laid down in this article.
4.4 The authentication credentials (email and password) allow the user to make purchases on the Website and to carry out, among others, the activities referred to in art. 4.2 above. They must therefore be kept with the utmost care and attention. They may be used only by the user and may not be transferred to third parties. The user undertakes to keep them secret and to ensure that no third party has access to them, as well as to promptly inform Marco Zanuso, by contacting him at the addresses indicated in art. 16 below, if he/she suspects or becomes aware of any improper use or improper disclosure of such credentials.
4.5 The user guarantees that the personal data provided during the registration procedure on the Website or at any other time and/or in any other context of his/her relationship with Marco Zanuso, including the data and information provided for invoicing purposes, are complete, truthful and refer to the user himself/herself, and undertakes to hold harmless and indemnify Marco Zanuso from any damage, compensation obligation and/or sanction arising from and/or in any way connected with the user’s breach of the warranty set out in this article and/or with the violation of the rules relating to registration on the Website and/or the storage of authentication credentials.
5) Price
5.1 The price of the eBook offered on the Website is expressed in Euro.
5.2 Marco Zanuso reserves the right to change the price of the eBook at any time, it being understood that the price of the eBook that will be charged to the user will be the one indicated in the order summary and displayed to the user before the order is sent, and that any changes (upwards or downwards) after that time will not be taken into account.
6) Modalità di pagamento
6.1 Il pagamento dell’eBook acquistato tramite il Sito può essere effettuato esclusivamente mediante PayPal.
7) Informazioni relative alle modalità di fruizione dell’eBook acquistati tramite il Sito
7.1 L’utente potrà fruire dell’eBook acquistato.
7.2 Il download e/o la visualizzazione dell’eBook potrà avvenire, dopo la conclusione del contratto e una volta avuta conferma del buon esito del pagamento.
8) Diritto di recesso dall’acquisto dell’eBook
8.1 L’utente che riveste la qualità di consumatore ha diritto di recedere dal contratto di acquisto dell’eBook senza dover fornire alcuna motivazione e senza dover sostenere alcun costo entro il termine di trenta giorni di calendario.
Il periodo di recesso scade (“Periodo di Recesso”) dopo 30 giorni a partire dal giorno in cui il contratto di acquisto dell’eBook è stato concluso (i.e. dal giorno in cui l’utente ha inviato l’ordine di acquisto).
8.2 Per esercitare il diritto di recesso, l’utente deve informare Marco Zanuso prima della scadenza del Periodo di Recesso della sua decisione di recedere.
8.3 A tal fine l’utente può:
(a) utilizzare il modulo di recesso, messo a sua disposizione sul Sito, tramite il link Modulo di Recesso; oppure
(b) presentare una qualsiasi altra dichiarazione esplicita della sua decisione di recedere dal contratto (“Dichiarazione di Recesso”).
8.4 L’utente ha esercitato il proprio diritto di recesso entro il Periodo di Recesso, se la comunicazione relativa all’esercizio del diritto di recesso è inviata dal consumatore prima della scadenza del Periodo di Recesso.
Il Modulo di Recesso o la Dichiarazione di Recesso devono essere inviati al seguente indirizzo e-mail info@leveltechnique.com.
Si segnala all’utente che, poiché l’onere della prova relativa all’esercizio del diritto di recesso prima della scadenza del Periodo di Recesso incombe sull’utente stesso, è nel suo interesse avvalersi di un supporto durevole quando comunica a Marco Zanuso il proprio recesso.
Nel caso in cui l’utente si avvalga della Dichiarazione di Recesso, si invita il consumatore a indicare nella Dichiarazione di Recesso il numero dell’ordine, l’eBook per il quale intende esercitare il diritto di recesso e il suo nome e cognome.
8.5 Se l’utente recede dal contratto, Marco Zanuso, procede al rimborso dell’Importo Dovuto pagato dall’utente, senza indebito ritardo e in ogni caso non oltre 30 giorni di calendario dal giorno in cui Marco Zanuso è stato informato della decisione dell’utente di recedere dal contratto.
Il rimborso dell’Importo Dovuto pagato dall’utente per l’eBook Reso sarà effettuato, tramite riaccredito sulla paypal intestata all’utente.
8.6 Parimenti, in tuti gli altri casi in cui il recesso non sia esercitato conformemente a quanto previsto dalla normativa applicabile, esso non comporterà la risoluzione del contratto e, conseguentemente, non darà diritto ad alcun rimborso.
Marco Zanuso ne darà comunicazione all’utente entro 5 giorni lavorativi dal relativo accertamento, respingendo la richiesta di recesso.
9) Circostanze al ricorrere delle quali il consumatore perde il diritto di recedere dall’acquisto di un eBook
9.1 L’utente che ha acquistato un eBook tramite il Sito può dunque recedere dal contratto di acquisto dell’eBook, nel termine di 30 giorni decorrenti dal giorno successivo a quello di invio dell’ordine, con le modalità di cui all’art.
8 che precede.
10) Uso dell’eBook
10.1 Marco Zanuso concede all’utente il diritto non esclusivo di vedere, usare e visualizzare l’eBook, esclusivamente per uso personale (escluso cioè qualsiasi uso commerciale e/o economico).
10.2 L’utente non potrà riprodurre, copiare, vendere o in altro modo distribuire, dare in noleggio o affitto, trasmettere, concedere in sub-licenza o altrimenti trasferire qualsiasi diritto relativo all’eBook e/o a qualsiasi parte dello stesso e non potrà togliere o modificare alcuna informazione dello stesso, compresa quelle relativa alla proprietà di tale eBook.
L’utente non potrà inoltre modificare, annullare o eludere i dispositivi di sicurezza che proteggono l’eBook e non potrà utilizzare tale eBook se non in conformità alla normativa vigente, alle presenti CGV, alle Condizioni d’Uso, che qui interamente si richiamano, ai diritti riservati a Marco Zanuso e/o agli autori del’eBook e/o ad eventuali altri terzi aventi diritto e a eventuali condizioni particolari d’uso indicate dagli stessi.
